Randomized controlled trials test new drugs using various debiasing devices to prevent participants from manipulating the trials. But participants often dislike controls, arguing that they impose a paternalist constraint on their legitimate preferences. The 21st Century Cures Act, passed by US Congress in 2016, encourages the Food and Drug Administration to use alternative testing methods, incorporating participants’ preferences, for regulatory purposes. We discuss, from a historical perspective, the trade-off between trial impartiality and participants’ freedom. We argue that the only way (...) out is considering which methods improve upon the performance of conventional trials in keeping dangerous or inefficacious compounds out of pharmaceutical markets. The debate about the meaning of color terms in the philosophy of language has been dominated by two main issues. Firstly, there is the discussion about the context-dependency of color terms, specifically, quantity, the degree to which the object is of the color, and one of the dimensions of color quality, hue. Secondly, there is the question of how indexical contextualism can account for these elements of context-dependence. The aim of this chapter is twofold. First, to examine brightness, one of (...) the dimensions of color quality that has been neglected in the literature. For this purpose, we will examine how the equivalent of “white” in Arabic and Spanish interacts with brightness modifiers. The analysis will allow us to distinguish three different usage patterns, light source, light reflection, and contrast between white and black, pointing to three new ways of contextual incompleteness of color terms. Second, to assess indexical theories of color terms considering these new empirical findings. We will argue that the results of our study offer support for indexical contextualist theories by distinguishing new dimensions of contextual incompleteness of color terms. However, the consequences of applying the standard indexical contextualist explanation–hidden-variable analysis– are too strong. (shrink)

Physical activity, body composition and sedentary behavior may affect the health of children. Therefore, this study examined the effect of an educational hybrid physical education program on physical fitness, body composition and sedentary and PA times in adolescents. A 9-month group-randomized controlled trial was conducted in 150 participants allocated into the control group and experimental group. Cardiorespiratory fitness, speed, strength, agility, flexibility and body mass index were assessed through previously validated field tests. Sedentary time, PA at school and afterschool were (...) evaluated with the Youth Activity Profile-Spain questionnaire. Significant differences were observed concerning to the CG in APA-weekend, speed-agility and agility. Regarding the intervention, cardiorespiratory fitness, speed-agility, strength, flexibility, agility, PA in school, APA-weekday, APA-weekend, APA-week, and sedentary time increased significantly in the EG. The use of a hybrid program based on teaching personal and social responsibility and gamification strategies produced enhancements in cardiorespiratory fitness, agility, speed, APA-weekdays and APA-weekends, reducing the sedentary time. Frente a las posiciones relativistas que consideran que no existe la posibilidad de trascender la perspectiva de una mirada necesariamente anclada en una u otra cultura y su equipaje conceptual, sostenemos que siendo innegablemente cierto que la ciencia es también un producto cultural, es sin embargo mucho más y se erige como un saber de tipo transcultural, es decir, que trasciende los elementos locales (...) de toda cultura y posee privilegios epistémicos que la posicionan por encima de cualquier otro tipo de conocimiento. El presente artículo tiene como objeto llevar a cabo un estudio pragmático y analítico sobre la acción de valoración, el valor y los valores a la luz de la ciencia semiótica y de la ciencia cibernética. Por ello, se desarrollará un proceso axiológico que ilustre cómo sucede el ingreso, la transición y la salida de códigos morales en función de un esquema cognitivo. Así pues, el proceso axiológico se postula, primero, en fundamento de tres sistemas: de mentalidad, de valores y (...) de biomoralidad y, segundo, conforme a la teoría de la información y de la teoría general de sistemas. «Fortaleza» y «debilidad» son dos adjetivos que se han utilizado prolijamente en la literatura científica sobre institucionalismo para describir la permanencia o, por el contrario, la porosidad y maleabilidad de las reglas y principios rectores en los que están atrincheradas las instituciones que sobreviven en equilibrio y, por tanto, no son alteradas unilateralmente.

Este libro es un homenaje a la trayectoria intelectual y académica de la profesora María Teresa López de la Vieja, Catedrática emérita de la Universidad de Salamanca. En él se trazan algunos de los caminos que, con su obra, nos invita a transitar. El volumen recoge contribuciones de colegas de varias nacionalidades y procedentes de diversos ámbitos de reflexión que le son afines: la filosofía moral y política, la literatura, la teoría de la argumentación, los estudios feministas, las éticas aplicadas, (...) la bioética. Some authors sustain that historical research is an effect of a specific historiographical context (Jenkins, 1991; González de Oleaga, 2009). An approach to the historiographical debate between constructivism and recontructivism is presented in this paper. Two theses are here defended. The first one affirms that the above mentioned debate is deeply related to epistemological questions (study of mental representations, different conceptions about historical reasoning functions, historical reasoning, cognitive bias, and informal falacies). The second thesis affirms that each historiographical conception can (...) be understood as the effect of assuming a specific perspective about these epistemic questions. As an evidence of this, some connections between historiography and epistemology will be analysed through the analogy between the reconstructivism vs. constructivism debate, and the epistemological debate detectivism vs. constitutivism (Finkelstein, 2003). Nel 1881, per i tipi dell’editore Brigola di Milano, vedeva la luce Macchiette parigine, un compendio di profili biografici che lo scrittore siciliano Emanuele Navarro della Miraglia (1838-1919) dedicava a eminenti personalità della cultura letteraria e artistica francese di metà Ottocento.Francesista, a lungo residente a Parigi (1864-1872), in contatto a Milano con gli ambienti della scapigliatura lombarda (1872-1882) e da ultimo professore di Lingua e letteratura francese presso l’Istituto superiore di magistero femminile di Roma (1883-1913), Navarro della Miraglia (...) includeva fra le sue “macchiette” anche due ritratti d’artisti dedicati rispettivamente a Gustave Courbet e a Jean-Baptiste Carpeaux.Questo contributo si propone di definire il contesto e le ricadute di una lettura non allineata alla tempestiva e più “ortodossa” discussione della lezione di Courbet promossa da Diego Martelli presso i macchiaioli toscani, a beneficio di una geografia culturale diversamente articolata fra le aperture cosmopolite del naturalismo meridionale e le frange più avanzate della scapigliatura lombarda. Allo stesso modo il resoconto dell’atelier di Carpeaux è riconsiderato alla luce del coevo dibattito sulla scultura monumentale e delle ricerche in corso a Milano su un modellato più mosso e nervoso. Finkelstein propone en La expresión y lo interno un análisis expresivista del autoconocimiento. Podría parecer cuando menos sorprendente y aún más admirable que con tan sólo dos capítulos (“Detectivismo y constitutivismo” y (...) “Expresión”) y un Epílogo (“Deliberación y transparencia”), Finkelstein haya conseguido presentar en esta obra un planteamiento calificado por muchos como una auténtica renovación de la discusión analítica en torno al tema del autoconocimiento, o sea, acerca del problema de qué clase de autoridad quepa atribuir a las expresiones sobre nuestros propios estados de ánimo y/o nuestros estados mentales sin más. Americans' appetite for life-prolonging therapies has led to unsustainable growth in health care costs. It is tempting to target older people for health care rationing based on their disproportionate use of health care resources and lifespan already lived, but aged-based rationing is unacceptable to many. Systems reforms can improve the efficiency of health care and may lessen pressure to ration services, but difficult choices still must be made to limit expensive, marginally beneficial interventions. In the absence of agreement on principles (...) to govern health care resource allocation, a fair, open priority-setting process should be created to allow for reasonable disagreement on principles while being seen as legitimate by all stakeholders. At the patient-care level, careful discussions about the benefits and burdens of medical intervention and support for slow medicine — a gentle, family-centered care approach for frail elders — can do much to avoid harming these patients with aggressive yet unwanted medical care while reducing wasteful spending. We may succed in the fulfilment of our desires but still fail to properly own our practical life, perhaps because we acted as addicts, driven by desires that are alien to our will, or as “wantons,” satisfying the desires that we simply happen to have (Frankfurt, 1988 ). May we equally fail to own the outcomes of our epistemic life? If so, how may we attain epistemic ownership over it? This paper explores the structural parallellism between practical and epistemic rationality, (...) building on Williamson’s ( 2002 ) suggestion that we should commence with successful performances as the foundation for both domains, be it action or knowledge. By highlighting the limitations of higher-order regulative approaches in epistemology, exemplified by Sosa ( 2007, 2011, 2015, 2021 ), the paper introduces a form of teleological epistemic constitutivism inspired by Velleman ( 2000, 2009 ). The proposal is that epistemic ownership is not attained in the mere pursuit of truth or knowledge, but requires furthermore a struggle to understand what we know. (shrink)

Speech Acts, Criteria and Intentions What makes a speech act a speech act? Which are its necessary and sufficient conditions? I claim in this paper that we cannot find an answer to those questions in Austin's doctrine of the infelicities, since some infelicities take place in fully committing speech acts, whereas others prevent the utterance from being considered as a speech act at all. With this qualification in mind, I argue against the idea that intentions—considered as mental states accomplishing a (...) causal role in the performance of the act—should be considered among the necessary conditions of speech acts. I would thus like to deny a merely ‘symptomatic’ account of intentions, according to which we could never make anything but fallible hypotheses about the effective occurrence of any speech act. I propose an alternative ‘criterial’ account of the role of intentions in speech acts theory, and analyse Austin's and Searle's approaches in the light of this Wittgensteinian concept. Whether we consider, with Austin, that speech acts ‘imply’ mental states or, with Searle, that they ‘express’ them, we could only make sense of this idea if we considered utterances as criteria for intentions, and not as alleged behavioural effects of hidden mental causes. La revolución cubana es un proceso en el cual la producción de imágenes es parte fundamental para explicar su desarrollo histórico. A través de una fotografía de Fidel Castro, capturada por el fotorreportero español Enrique Meneses, se muestra la posibilidad de hacer una historia -en apego a la propuesta de John Mraz- con y de fotografías. Dicha representación iconográfica, toma de Fidel Castro en Sierra Maestra en los primeros meses de 1958, y que se integró en la edición de un (...) libro del mismo fotógrafo, ofrece una buena oportunidad para reflexionar sobre los aportes que tiene la iconología en el Circuncaribe, y toda América Latina. Este artículo analiza una fotografía de Fidel Castro que es muy lejana a la etapa épica del guerrillero, pero que forma parte de la iconografía en torno a este personaje. Se trata de un retrato de Fidel a los tres años, tomado en Birán, en 1929, estudiado con el objeto de comprender los intereses y las inten ciones alrededor de su producción, así como los usos actuales de esa misma imagen. Partiendo de la consideración de la fotografía como una práctica (...) social y cultural que integra significados, ella debe ser incorporada en el estudio de la historia como un documento que permite aportar información de sus contextos de producción y reproducción. A partir de estas consideraciones, se pudo observar el significado de la representación iconográfica de Fidel a los tres años, quien fue fotografiado utilizando convenciones que resaltaban las favorables condiciones económicas de las que gozaba la familia Castro Ruz, sin embargo, la investigación revela que se le han añadido significados en sus posteriores usos, producto de intereses políticos en torno a la trayectoria guerrillera de Fidel. Las definiciones de argumentación son tan variadas como las distintas posiciones existentes en torno a la pregunta de qué hacemos exactamente cuando argumentamos y cuándo estamos, de hecho, argumentando. Incluso el mismo autor puede ofrecer más de una definición de lo que entiende por argumentación; en parte, porque el problema de la argumentación no se circunscribe a un solo ámbito, ni del conocimiento ni de la vida práctica.

This paper aims to provide two abductive considerations adducing in favor of the thesis of Necessitism in modal ontology. I demonstrate how instances of the Barcan formula can be witnessed, when the modal operators are interpreted 'naturally' -- i.e., as including geometric possibilities -- and the quantifiers in the formula range over a domain of natural, or concrete, entities and their contingently non-concrete analogues. I argue that, because there are considerations within physics and metaphysical inquiry which corroborate modal relationalist claims (...) concerning the possible geometric structures of spacetime, and dispositional properties are actual possible entities, the condition of being grounded in the concrete is consistent with the Barcan formula; and thus -- in the geometric setting -- merits adoption by the Necessitist. This paper addresses some relations between the spatial politics of queer assemblies in spaces of protest and the constitution of collective political subjects. It does so by exploring the spatial politics of queer activism within the global Occupy movements, in the light of Judith Butler’s work on the performative power of assembly and the ambivalences of the Foucauldian concept of heterotopia. Specific challenges faced by queer activists in various encampments will be addressed in order to expose some tensions between the (...) constitutive exclusions inherent to the constitution of spaces of protest and the processes of coalition building needed to effectively overcome those very constitutive exclusions. In this article, I focus on the work of the Movement of Victims of State Crimes in Colombia. The work of Movice, I suggest, is an example of how the category of “victim” from international law discourse is adopted and used from below by victims of mass atrocities. I show that, through this category, Movice attempts to introduce an alternative narrative of the internal armed conflict in which the state is a perpetrator of violence against civilian population as part of (...) a practice of elimination of political opposition through violent means. To do this, I focus on three political opportunities in which Movice deployed the category of victim between 2005 and 2016. I suggest that Movice is an example of how a movement of victims can adopt categories of international law to frame their struggles and, in doing so, infuse them with new contents. (shrink)

Based on his Inclosure Schema and the Principle of Uniform Solution (PUS), Priest has argued that Curry’s paradox belongs to a different family of paradoxes than the Liar. Pleitz (2015, The Logica Yearbook 2014, pp. 233–248) argued that Curry’s paradox shares the same structure as the other paradoxes and proposed a scheme of which the Inclosure Schema is a particular case and he criticizes Priest’s position by pointing out that applying the PUS implies the use of a paraconsistent logic that (...) does not validate Contraction, but that this can hardly seen as uniform. In this paper, we will develop some further reasons to defend Pleitz’ thesis that Curry’s paradox belongs to the same family as the rest of the self-referential paradoxes & using the idea that conditionals are generalized negations. However, we will not follow Pleitz in considering doubtful that there is a uniform solution for the paradoxes in a paraconsistent spirit. We will argue that the paraconsistent strategies can be seen as special cases of the strategy of restricting Detachment and that the latter uniformly blocks all the connective-involving self-referential paradoxes, including Curry’s. Part of the appeal of the biological approach to personal identity is that it does not have to countenance spatially coincident entities. But if the termination thesis is correct and the organism ceases to exist at death, then it appears that the corpse is a dead body that earlier was a living body and distinct from but spatially coincident with the organism. If the organism is identified with the body, then the unwelcome spatial coincidence could perhaps be avoided. It is (...) argued that such an identification would be a mistake. A living organism has a different part/whole relationship and persistence conditions than the alleged body. A case will be made that the concept ‘human body’ is a conceptual mess, vague in an unprincipled manner, and that an eliminativist stance towards dead bodies is the appropriate response. In this paper art history and visual studies, the disciplines that study visual culture, are presented as a field whose conjectural paradigm can be used to understand the epistemic problems associated with abduction. In order to do so, significant statements, concepts and arguments from the work of several specialists in this field have been highlighted. Their analysis shows the fruitfulness and potential for understanding the study of visual culture as a field that is interwoven with the assumptions of abductive cognition.

Reductive intellectualists (e.g., Stanley & Williamson 2001; Stanley 2011a; 2011b; Brogaard 2008; 2009; 2011) hold that knowledge-how is a kind of knowledge-that. If this thesis is correct, then we should expect the defeasibility conditions for knowledge-how and knowledge-that to be uniform—viz., that the mechanisms of epistemic defeat which undermine propositional knowledge will be equally capable of imperilling knowledge-how. The goal of this paper is twofold: first, against intellectualism, we will show that knowledge-how is in fact resilient to being undermined by (...) the very kinds of traditional (propositional) epistemic defeaters which clearly defeat the items of propositional knowledge which intellectualists identify with knowledge-how. Second, we aim to fill an important lacuna in the contemporary debate, which is to develop an alternative way in which epistemic defeat for knowledge-how could be modelled within an anti-intellectualist framework. Quoting Flaubert through time, Mieke Bal and Michelle Williams Gamaker’s Madame B brings Madame Bovary’s reflections on love and emotions to the present day, in a productive anachronism. Their work produces an intertemporal space where the past is relevant for the present, and the present enables us to understand the past. Intimacy and routine are central in their exploration of Flaubert’s contemporaneity. Those issues are precisely one of the keys in Karl Ove Knausgård’s project of literary autobiography, where he expands (...) narration foreclosing the ellipsis and giving visibility to small things and emotions; a project with some resonances with Munch’s crude-obscene uses of intimacy. This essay explores how both proposals, Bal and Williams Gamaker in film, and Knausgård in literature, can serve us to connect present and past sensibilities and, more than that, demonstrate resistances to the hegemonic discourses of temporality. La profesión de carpintero de ribera, sus técnicas, las herramientas utilizadas, los productos finales: los barcos, así como los conocimientos necesarios para su fabricación forman parte del patrimonio cultural marítimo universal. La construcción en madera es un oficio milenario que está en peligro de desaparición, y con ella uno de los elementos identitarios más importantes de las regiones costeras europeas. La escasa historiografía académica sobre los carpinteros de ribera como protagonistas es el principal motivo de este trabajo, que se adentra (...) en sus raíces, dando a conocer algunos de los aspectos más relevantes que definen e identifican la importancia del tema, como las principales actividades desarrolladas, su contextualización histórica, las técnicas, herramientas y la lengua franca marinera que compartían. Por ello, el fin último es proporcionar una fuente de referencia a quiénes apuesten, tanto de manera teórica como práctica, por la recuperación y la conservación de esta profesión ancestral sobre la que apenas existe información e investigación. Se concluye que la recuperación y gestión de este patrimonio, con vinculaciones amplias con otras actividades relacionadas, puede abrir perspectivas de consolidación patrimonial y económica en espacios marítimos poco desarrollados, ya que puede servir para sentar las bases de un futuro turismo cultural en el que estas técnicas sean protagonistas y sirvan para potenciar la identidad marítima en las regiones litorales. As a continuation of the work of the third author in [5], we make further observations on the features of Galois cohomology in the general model theoretic context. We make explicit the connection between forms of definable groups and first cohomology sets with coefficients in a suitable automorphism group. We then use a method of twisting cohomology (inspired by Serre’s algebraic twisting) to describe arbitrary fibres in cohomology sequences—yielding a useful “finiteness” result on cohomology sets. Applied to the special case (...) of differential fields and Kolchin’s constrained cohomology, we complete results from [3] by proving that the first constrained cohomology set of a differential algebraic group over a bounded, differentially large, field is countable.
